(A) Every person engaging in or about to engage in business as an operator of a hotel in the city shall register with the City Manager on a form provided by the city.

(1) Registration shall be through the city’s short-term rental permit application.

(2) The privilege of registration after the date of imposition of such tax shall not relieve any person from the obligation of payment or collection of tax regardless of registration.

(B) Registrations must be accompanied by the fire and life safety inspection and evaluation fee (does apply to renewals), in addition to the registration fee of $50. Thereafter, the registration fee shall be due annually by July 1 of each succeeding year. There will be no pro-rationing of payments within any single year.

(C) Registration sets forth the name under which the operator transacts or intends to transact business, the location and proof of insurance of his or her place or places of business, and such other information to facilitate the collection of the tax as the City Manager may require. The operator shall sign the registration.

(D) The City Manager shall, within ten business days after registration, issue without charge, a certificate of authority to each registrant to collect the tax from the occupant, together with a duplicate thereof for each additional place or business or each registrant; as well as a new short-term rental permit.

(1) Certificates shall be non-assignable and non-transferable and shall be surrendered immediately to the City Manager upon the cessation of business at the location named or upon its sale or transfer.

(2) Each certificate and duplicate shall state the place of business to which it is applicable and shall be prominently displayed so as to be seen and come to the notice readily of all occupants and persons seeking occupancy.

(3) Said certificate shall, among other things, state the following:

(a) The name of the operator;

(b) The address of the hotel;

(c) The date upon which the certificate was issued; and

(d) Include the following statement:

This TRANSIENT OCCUPANCY REGISTRATION CERTIFICATE signifies that the person named on the face hereof has fulfilled the requirements of the TRANSIENT LODGINGS TAX ORDINANCE OF THE CITY OF NEHALEM, OREGON, by registration with the City Manager for the purpose of collecting from transients the lodgings tax imposed by said City and remitting said tax to the City Manager. This certificate does not authorize any person to conduct any unlawful business or to conduct any lawful business in an unlawful manner; or to operate a hotel without strictly complying with all local applicable laws, including, but not limited to those requiring a permit from any board, commission, department or office of the City of Nehalem, Tillamook County or the State of Oregon. This certificate does not constitute a permit.
