(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code.

(B) 

(1) Fines.

(a) In addition to any other fine or citation issued under any other city ordinance or applicable provision of state law, a minor found in violation of § 130.01 of this chapter shall be subject to the following fines:

(1) First offense: written warning;

(2) Second offense: $50;

(3) Third offense: $100; and

(4) Fourth and continuing offenses: $500.

(b) If a violation of § 130.01 of this chapter occurs where the minor is 15 years of age or younger, any citation or fine issued shall be to the parent, guardian or person having legal care and not to the minor. It shall be an affirmative defense if the parent, guardian or person having legal care of a minor took reasonable steps to control the action of the minor or reported the action to the appropriate authorities.

(2) Community service. A court having jurisdiction may assign community service to the minor in lieu of the fine contained herein.

(3) Custody. Any minor who violates § 130.01 of this chapter may be taken into custody as provided in O.R.S. 419C.080, 419C.085 and 419C.088 and may be subjected to further proceedings as provided in O.R.S. Ch. 419C.

(C) Violation of, or failure to comply with, any provision of § 130.02 of this chapter is punishable, upon conviction, by a fine not to exceed $1,000 or imprisonment in jail not to exceed one year, or both such fine and imprisonment.

(D) Any person violating any of the provisions of § 130.03 of this chapter shall, upon conviction thereof in the Municipal Court, be to punished by a fine not exceeding $10 or by imprisonment in the City Jail for a period exceeding five days, or by both such fine and imprisonment.
