For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

MARIJUANA ITEM. Marijuana, cannabinoid products, concentrates, and extracts as described in Oregon Laws 2015, Chapter 614, Section 1.

MARIJUANA RETAILER. A person who sells marijuana items to a consumer within the City of Nehalem or in the State of Oregon.

RECREATIONAL MARIJUANA DISPENSARY. Any facility or operation designed, intended, or used for purposes of functioning as a marijuana retailer. Recreational marijuana dispensary does not include a medical marijuana dispensary.

RETAIL SALE PRICE. The price paid for a marijuana item, excluding tax, to a marijuana retailer by or on behalf of a consumer of the marijuana item. (Ord. 2016-02, passed 06/13/2016)
