(A) Within 30 days of receipt of the minor partition, the City Manager/Recorder shall transmit to the Planning Commission or the designated staff his or her written report or recommendation including available reports and recommendation of the City Engineer and/or other affected agencies.

(B) After receipt of the City Manager/Recorder’s report, the Planning Commission shall take action on the proposed partition at a regular meeting.

(1) The Planning Commission shall determine whether the proposal is compatible with Ch. 157 of this code of ordinances and other requirements of the city.

(2) In approving a minor partition, the Planning Commission may require modifications in the proposal or list specific conditions to be met such as the dedication of easements.

(C) Approved partitions shall be signed by the Planning Commission Chairperson.

(1) The date of approval and any conditions attached to the approval shall also be marked on the partition.

(2) Upon final approval, the partitioner may proceed to sell the lots without further action or filing on his or her part.

(D) Approved copies shall be distributed by the City Manager/Recorder as follows:

(1) One copy for use by the City Engineer;

(2) One copy for use by the City Council; and

(3) One copy for use by the County Surveyor and one copy for use by the County Assessor, each indicating the same has been approved.

(E) Decisions by the Planning Commission may be appealed to the City Council in accordance with § 156.028 of this chapter. (Ord. 80-3, passed 04/12/2004)
