(A) In residential zones, home occupations are allowed in order to promote a local economic base consistent with the character of the city.

(1) Allowable uses include light manufacturing, crafts and small-scale services which have little impact on the neighborhood in terms of traffic generation, noise, appearance and operating hours.

(2) Activities are to be allowed on an implied contractual basis, with the primary stipulation that approval can be revoked for violation of standards.

(B) All home occupations shall meet the following standards and/or conditions in addition to all other applicable ordinance requirements:

(1) It is operated by the resident/owner of the property upon which the activity is located within the residence or accessory structure(s);

(2) It will employ no more than four full- or part-time persons, including the resident/owner;

(3) It will not interfere with existing users on nearby land or with other uses permitted in the zone in which the property is located;

(4) Where home occupations are allowed conditionally, conditions of approval shall limit retail sales, signs, traffic, noise, obnoxious odors, hazardous activities and other identifiable adverse off-site impacts;

(5) The existence of a home occupation shall not be used as justification for a zone change or Comprehensive Plan amendment;

(6) Signs shall conform to §§ 157.325 through 157.333 of this chapter;

(7) Uses involving the delivery of materials shall be limited to between 8:00 a.m. and 6:00 p.m. daily;

(8) The use shall be architecturally and aesthetically compatible with the surrounding residential area and the existing structure(s) on the site;

(9) There shall be no outdoor storage of materials or equipment;

(10) Noise generated by the home occupation shall be limited to two decibels (2dBs) measured 20 feet from the outside of the building or half the distance to the nearest structure, whichever is less; and

(11) Machinery shall not be operated except between the hours of 8:00 a.m. and 5:00 p.m. daily.

(C) Home occupations permitted outright shall meet the following additional standards or requirements.

(1) The owner/resident must reside on the same property as the home occupation.

(2) There shall be no activities that give the outward appearance or manifest the characteristics of a retail business, such as:

(a) Signs other than those permitted under §§ 157.325 through 157.333 of this chapter;

(b) Advertising of the dwelling as a business location;

(c) More than six customers daily entering the business premises;

(d) More than two customer vehicles at a time;

(e) Noise that adversely affects neighbors;

(f) Obnoxious odors;

(g) Hazardous activities; and

(h) Other adverse off-site impacts.

(3) Complaints from neighbors may be cause for requiring a conditional use review of the activity. (Ord. 80-2, passed 06/14/2010)
