(A) Notice by City Manager/Recorder to interested persons. Within 30 days of receipt of a complete application, including payment of the required fee in full, the City Manager/Recorder shall send by first class mail, a notice of the application to the following:

(1) The applicant;

(2) All owners of property within 250 feet of the parcel on which a decision is requested;

(3) The owner of the title to real property or the contract purchaser of real property, as shown in the last available complete assessment roll in the office of the County Assessor, if the applicant is not the owner;

(4) Any person, agency or organization that has filed with the City Manager/Recorder written request to receive notice on the matter;

(5) Other persons, agencies or organizations the City Manager/Recorder deems appropriate; and

(6) Members of the Planning Commission.

(B) Content of division (A)’s notice. The notice described above shall:

(1) Generally describe the nature of the request;

(2) Set forth the street address or other easily understood geographical reference to the property involved in the request;

(3) List the applicable criteria from the ordinance and the Comprehensive Plan and/or Ch. 156 of this code of ordinances that apply to the matter;

(4) State the name of the applicant;

(5) State that a completed application has been received;

(6) State that there is a right to respond with oral or written comments or objections to the proposal;

(7) State that the Planning Commission shall hold a public hearing on the application on the date and at the time and place specified in the notice, such date not less than 20, nor more than 50, days from the date the notice was mailed;

(8) State that the City Manager/Recorder shall prepare a report on the matter which, along with a copy of the application, all documents and evidence relied upon by the applicant and applicable criteria will be available for public inspection and copying at reasonable cost at City Hall not less than ten days before the hearing;

(9) State that failure of an issue to be raised either in writing before or during the hearing or orally at the hearing or to raised with sufficient specificity to afford the Planning Commission an opportunity to respond to the issue shall preclude appeal to the City Council on that issue;

(10) Include the City Manager/Recorder’s name and business telephone number to contact for additional information during regular working hours; and

(11) Include a general explanation of the requirements for submission of testimony and the procedure for conduct of the hearings.

(C) Publication of notice. The City Manager/Recorder shall cause the notice described in division (B) above to be published in a newspaper of general circulation within the city at least ten days before the public hearing. (Ord. 80-2, passed 06/14/2010)
