No person, firm or corporation, or any employee, agent or representative of any such person, firm or corporation, shall dig a hole or make excavations in or upon any street, alley, sidewalk or curbing of the city; change, alter or destroy the surface of any such street, alley, sidewalk or curbing; obstruct the reasonable use of pedestrian travel over and upon such street, alley, sidewalk or curbing, except as provided by franchise, without first having received written permission from the City Manager, except in the case of emergencies as set out in this subchapter.

(A) The City Manager is hereby named and designated as the duly appointed and authorized official and is hereby delegated with full power and authority to act for the city is the issuance of written permission.

(B) As used in this subchapter the word STREETS shall include all streets, alleys, sidewalks and curbing within the city.

(C) Also, the provisions of this subchapter shall not apply to the installation of utility poles and boxes, except in areas where streets, alleys, sidewalks or curbing are surfaced. (Ord. 2014-07, passed 11/10/2014)
