(A) By Council action. The Council may initiate formation of an LID upon its own motion.

(B) By petition.

(1) Notification of the City Recorder. Any interested person or group of persons may notify the City Recorder in writing of that person’s or group’s intent to initiate formation of an LID to finance a local improvement. Upon such notification, the City Recorder, should he or she believe the local improvement qualifies for LID treatment, shall define the area benefitting from the improvement.

(2) Approval percentage. To initiate the LID procedure by petition, equity property owners representing 33% of the total property value (as determined by reference to the most current county tax-appraised value of the properties in question) of the area defined by the City Recorder as benefitting from the improvement must sign and date the petition, and no signature must be more than six months old.

(3) Resolution authorizing initiation of LID process. The Council, upon approval of its own motion or upon presentation of the requisite signatures described in division (B)(2) above shall adopt a resolution:

(a) Declaring its intent to initiate the improvement;

(b) Directing the City Recorder or other party to prepare a report. The report shall describe the project, estimate its probable cost, list the properties that will be benefitted by the project and recommend whether or not the project is feasible; and

(c) Describing the proposed boundaries of the LID, which shall include all areas benefitting from the improvement. (Ord. 92-05, passed 12/15/1992)
