(A) Filing of report. Upon completion of the report described in § 154.03(B)(2) of this chapter, the same shall be filed in the records of the city, available for public inspection and mailed to each Council member.

(B) Notice of project hearing.

(1) Timeliness. The City Recorder shall notify the property owners within the proposed local improvement district of the project hearing by depositing such notice in the U.S. mail within 60 days of the filing of the report and at least 14 days before the hearing described in division (C) below, such notice addressed to the effected property owners at their last address known to the city or, if none is known, to the owner at the address where the property is located.

(2) Publication of notice. Additionally, the City Recorder shall publish notice of the hearing in a newspaper of general circulation within the city at least ten days before the hearing.

(3) Content of notice. The notice shall specify the time when and the place where the Council will hear and consider comments on objections to or remonstrances to the proposed local improvement by any parties interested therein or aggrieved thereby. The notice shall state that a report on the project is available at City Hall for public inspection.

(C) Project hearing. The purpose of the project hearing is to receive comments, objections or remonstrances as to whether or not the improvement should be made and whether or not assessments should be imposed upon the property within the proposed LID boundaries. Oral and written testimony may be presented.

(D) Determination to proceed with the project. Within 60 days of the project hearing described in division (C) above, the Council shall, by resolution, make the determinations described in that section and shall authorize the City Recorder or party to prepare a report, which shall include the following:

(1) The estimated cost of the project, ascertained on the basis of the contract award or the departmental cost to the city, if the city proposes to undertake the project, including the cost of property acquisition, engineering and construction (or maintenance or repair), plus 10% of that figure for advertising, accounting, legal and overhead expenses;

(2) The method of assessment to be used for properties within the LID; and

(3) Proposed final boundaries for the LID. (Ord. 92-05, passed 12/15/1992)
