(A) General provisions.

(1) The city park is open to all individuals, groups and organizations for recreational use, on a first-come first-served basis. No application is required and at no time shall the park be reserved to any one individual, group or organization for use. No part of the park will be fenced or roped off for any reason by any individual, with the sole exception being the city itself for maintenance or repair, or for other interests of the public’s health, safety or welfare. There shall be no open burning of any type allowed, save and except for the use of barbeques or other types of enclosed cooking devices, within the park itself.

(2) No fee or refundable deposit is required to use the park itself, in accordance with Res. 2007-08. However, if an individual, group or organization wishes to utilize available electrical power at the park, a non-refundable fee of $50 per day is required and must be paid no later than seven days prior to the event.

(3) Neglect, failure or refusal to follow the laws and/or officers, agents or employee having standing of the United States, the state, the county or the city, or any provision of this or any other city ordinance may call for the immediate cessation or cancellation of the event and forfeit of any and all payments, fees and/or deposits, in addition to any civil or criminal fines or penalties which may also be assessed. Any employee of the city and law enforcement officials shall have the authority to enter the park and related areas at any and all times to monitor/spot check any event to ensure compliance with the policies and laws of the city, county or state, as they may apply.

(4) Activities must be lawful in all respects and be conducted in good taste for the occasion. Disorderly conduct of any type is strictly prohibited and is grounds for cessation of the park’s use and the event itself. Such activities may preclude the park user from using the park or renting other property of the city again and/or lead to criminal and/or civil charges.

(5) Park users will be held solely responsible for all attendees to their event. Users of the park are to be considerate to neighboring residents and businesses in the vicinity regarding noise levels and parking, to name a few. The city may recover from the park users any costs or expenses for damages to city personnel or property which occur during the time of or related to their use.

(B) Bands and amplified music or voice. Any bands or amplified music or voice must be kept at levels which do not disturb the reasonable peace and quiet of any residence or nearby property. If noise exceeds reasonable sound limits, the city or any law enforcement official reserves the right to immediately terminate the music or the event itself.

(C) Alcohol use. Use of alcoholic beverages shall also be subject to all local, state and/or federal requirements and/or laws and, through implied consent, § 90.04 of this chapter. (Ord. 2008-02, passed 06/9/2008)
