(A) Street lights may be installed and maintained:

(1) At all intersections;

(2) In the middle of long blocks, as generally determined by every 400 feet from the nearest intersection;

(3) In dead end streets and long cul-de-sacs;

(4) At any location where a physical characteristic of the land (hill, ravine, sharp curve and the like) warrants placement in the interest of public safety; and

(5) At any other location where it is determined that the public’s health and/or safety may warrant such increased lighting (high crime area, senior center, schools and the like) where it is impractical for private lights to accomplish the same.

(B) Approval of the City Council shall be secured for major additions or revisions to the street lighting system where such additions and/or revisions affect 2% or greater of the city’s entire street lighting system.

(1) Approval of the City Manager shall be secured for minor additions or revisions where such additions and/or revisions affect less than 2% of the city’s entire street lighting system.

(2) Exceptions:

(a) Street lighting in gated communities where such streets remain in common ownership are considered private lights and are not subject to this chapter. Such lighting may be subject to requirements, conditions or recommendations of the city’s Planning Commission; and

(b) The city’s Planning Commission upon recommendation of the City Manager shall approve of any addition or revision to street lighting that is connected to a planned development, major partition of land where a public street is to be dedicated or other similar act.

(C) The City Manager shall maintain a street lighting map showing location and type of street light facilities within the city.

(D) The City Manager shall designate the timing of street light installations within new subdivisions, considering the extent of development and occupancy of structures.

(E) All street lights to be installed as part of a planned development, subdivision, major land partition or other like activity shall be done so at the sole expense of the developer(s). All locations of proposed street lights will be subject to approval by the Planning Commission through the application phase of each planned development, subdivision, major land partition and the like. No proposed street light shall be approved of if it violates any provision of this chapter or any other ordinance, rule or regulation of the city or another entity having jurisdiction.
